Terms & Conditions of Sale: Silky Maine Coons

These Terms & Conditions apply to all sales of kittens and cats from Silky Maine Coons. By placing a deposit or purchasing a kitten, the Buyer acknowledges they have read, understood, and agreed to these terms, which reflect the ANCATS Code of Ethics and Code of Practice.

1. General Provisions

  • 1.1 Ethics: All kittens are bred and raised in accordance with ANCATS ethical and welfare guidelines.

  • 1.2 Ownership: All kittens remain the legal property of Silky Maine Coons until the full purchase price has been received and the kitten has been physically transferred to the Buyer.

  • 1.3 Agreement: Placing a deposit constitutes a binding agreement to these terms.

2. Reservations & Deposits

  • 2.1 Allocation: Kittens are offered on a first-come, first-served basis; however, the Breeder reserves the right to refuse a sale if a home is deemed unsuitable.

  • 2.2 Deposit: A 25% non-refundable deposit is required to reserve a kitten.

  • 2.3 Refund Exception: If the Breeder cancels the sale due to the kitten becoming unavailable or failing a health check prior to departure, the deposit will be refunded in full. If the Buyer cancels the sale, the deposit is forfeited.

  • 2.4 Transfers: Deposits may be transferred to another kitten or a future litter at the Breeder's sole discretion.

3. Pricing & Payment

  • 3.1 Finality: All prices are set individually. All sales are final.

  • 3.2 Payment Timeline: Full payment must be cleared in the Breeder’s account before microchipping, and desexing can occur. No veterinary procedures, registrations, or ownership transfers will be initiated until funds are cleared in full.

4. Health & Veterinary Standards

  • 4.1 Pre-Departure Care: In accordance with ANCATS standards and Australian law, all kittens will leave with:

    • Age-appropriate vaccinations (minimum two rounds).

    • Regular internal and external parasite treatment (flea/worming).

    • A comprehensive veterinary health check.

    • Microchipping and Desexing.

  • 4.2 Buyer’s Health Check: The Buyer must have the kitten examined by their own licensed veterinarian within 72 hours of pickup/delivery. Failure to do so voids any early health claims.

5. Returns, Refunds & Congenital Health

  • 5.1 Initial Return Period: Within 3 days of pickup, if the Buyer can no longer keep the kitten for any non-health reason, the kitten may be returned for a 75% refund of the purchase price (less deposit).

  • 5.2 Short-Term Health: If a licensed vet confirms a life-threatening health issue within 21 days of pickup, the Breeder will provide a refund or replacement once the kitten is returned. This excludes minor, stress-induced, or common conditions (e.g., mild URI, temporary diarrhoea, or parasites).

  • 5.3 Congenital Health: Regardless of health testing, genetic problems can still occur. If a kitten is diagnosed with a life-threatening congenital defect within the first 12 months of life, the Buyer may request a replacement kitten of similar quality OR a refund of the purchase price. This request will only be processed after the return of the original kitten to the Breeder and receipt of a comprehensive report from a qualified veterinary specialist.

  • 5.4 Ongoing Costs: All veterinary costs or emergency fees incurred after the kitten leaves the Breeder's care are the sole responsibility of the Buyer.

  • 5.5 Pet Insurance: The buyer agrees that they will obtain pet insurance for the lifespan of their cat.

6. Breeding & Desexing

  • 6.1 No Breeding Rights: All kittens are sold as "Pet Only" and are desexed prior to leaving the cattery.

  • 6.2 Restrictions: Breeding from a Silky Maine Coon without express written consent is a breach of contract and may result in legal action.

7. Welfare, Housing & Socialisation

  • 7.1 Living Conditions: The Buyer agrees the cat will live exclusively indoors or within a secure outdoor enclosure. Roaming is strictly prohibited.

  • 7.2 Prohibited Practices: The cat must never be declawed or subjected to any non-essential cosmetic surgery.

  • 7.3 Maintenance: The Buyer agrees to maintain high-quality nutrition (suitable for large breed growth) and ongoing veterinary care.

8. Pickup, Delivery & Transport

  • 8.1 Timeline: Kittens typically go home between 12 and 16 weeks of age.

  • 8.2 Transport Costs: All transport costs are the Buyer's responsibility and are non-refundable.

  • 8.3 Transfer of Risk: Responsibility for the kitten’s safety and well-being transfers to the Buyer the moment the kitten leaves the Breeder’s premises. If a third-party courier is used, they are deemed an agent of the Buyer, and the Breeder is not liable for incidents occurring in transit.

9. Rehoming Policy

  • 9.1 Right of First Refusal: If the Buyer can no longer keep the cat at any stage of its life, Silky Maine Coons must be notified first.

  • 9.2 No Shelters: The cat must never be surrendered to a shelter or pound. We will assist in rehoming, though no refund will be issued after the initial 21-day period.

10. Documentation

  • 10.1 At Pickup: Buyer receives the Vaccination Card, Health Certificate, and Desexing Certificate.

  • 10.2 Pedigree Papers: ANCATS Pedigree/Registration papers will be sent via Registered Post once processed by the registry.

11. Media & Privacy

  • 11.1 Rights: We reserve the right to use photos/videos of the kitten taken while in our care for marketing.

  • 11.2 Updates: Any photos shared with the Breeder by the Buyer may be shared on our social media unless the Buyer explicitly requests otherwise.

12. Limitation of Liability

  • 12.1 Post-Transfer: Silky Maine Coons is not liable for any injury, illness, or damage caused to or by the kitten once it has left our care.

  • 12.2 Financial Limit: In all circumstances, the Breeder’s maximum financial liability is limited to the original purchase price of the kitten.

By proceeding with a deposit, you confirm your agreement to these terms.
